Acceptable Use Policy

Below is the black and white details of our Acceptable Use Policy that are agreed and bound to when using our services. Please read and understand our AUP carefully before signing up and using our services.

Please review this policy carefully before purchasing or using our services. This Acceptable Use Policy (“AUP”) outlines acceptable use of SolaDrive’s services. Violating these terms may result in suspension or termination. In any dispute regarding the interpretation of this AUP, SolaDrive’s interpretation, based on reasonable commercial judgment, shall govern.

1. Offensive Content

You may not publish or transmit any content through SolaDrive’s services that we reasonably believe:

  • Contains child exploitation materials or any content involving minors in a sexual context;
  • Is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
  • Is unfair or deceptive under consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
  • Is defamatory or violates a person’s privacy;
  • Creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with law enforcement investigations;
  • Improperly exposes trade secrets or other confidential or proprietary information of another person;
  • Is intended to assist others in defeating technical copyright protections;
  • Clearly infringes on another person’s trade or service mark, patent, or other property right;
  • Promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
  • Is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to SolaDrive;
  • Is otherwise malicious, fraudulent, or may result in retaliation against SolaDrive by offended viewers.

Content “published or transmitted” through SolaDrive’s services includes web content, email, bulletin board postings, chat, and any other type of posting or transmission that relies on any service provided by SolaDrive.

2. Prohibited Materials and Services

The following materials and services are strictly prohibited on SolaDrive’s network:
  • Child exploitation materials or any content involving minors in a sexual context;
  • IRC bots, clients, servers, or any IRC-related services;
  • Proxy scripts and anonymizers intended for malicious use;
  • Pirated software, warez, or any illegally distributed copyrighted content;
  • Phishing sites or any fraudulent websites designed to deceive users;
  • Hate sites or content promoting violence against individuals or groups;
  • Hacker-focused sites, archives, or programs intended for malicious purposes;
  • Sites actively promoting or facilitating illegal activities;
  • Public Tor exit nodes (Tor relays may be permitted with prior approval);
  • Cryptocurrency mining operations that negatively impact server or network performance;
  • Any file-sharing or P2P services used primarily for distributing copyrighted material without authorization.

Legal adult content is permitted provided it complies with all applicable laws, does not involve minors, and appropriate age verification measures are in place.

SolaDrive reserves the right to terminate services for any of the above reasons at its sole discretion.

3. Network Abuse

SolaDrive strictly prohibits all forms of network abuse, including but not limited to denial-of-service attacks, phishing, port scans, and SYN floods. SolaDrive reserves the right to determine what constitutes network abuse and take appropriate action, with or without prior notification.

You may not engage in illegal, abusive, or irresponsible behavior, including but not limited to:

  • Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner;
  • Monitoring data or traffic on any network or system without the authorization of the owner;
  • Interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, and broadcast attacks;
  • Use of an Internet account or computer without the owner’s authorization, including but not limited to Internet scanning, password theft, security hole scanning, and port scanning;
  • Forging of any TCP/IP packet header or any part of the header information in an email or newsgroup posting;
  • Any conduct that is likely to result in retaliation against SolaDrive’s network or services;
  • Use of SolaDrive’s network in a way that unreasonably interferes with other customers’ use of the same resources.

4. Resource Usage

As a VPS and dedicated server provider, SolaDrive gives customers significant flexibility in how they use their allocated resources. You may use your services for web hosting, file storage, email services, media streaming, databases, application hosting, and other legitimate purposes.

However, customers are prohibited from engaging in activities that negatively impact network stability or other customers’ services. This includes:

  • Activities that cause network congestion or degrade service for other customers;
  • Running processes that negatively impact shared network infrastructure;
  • Engaging in activities that result in our IP addresses being blacklisted;
  • Using resources in a manner that violates our Terms of Service or this AUP.

SolaDrive reserves the right to take appropriate actions to maintain network integrity. If your usage is causing issues, we will typically contact you first to resolve the situation before taking any action on your account.

5. Security

You must take reasonable security precautions for your account and services. This includes:

  • Protecting the confidentiality of your password and changing it periodically;
  • Never sharing your login credentials with unauthorized parties;
  • Keeping all installed software updated and patched according to industry best practices;
  • Implementing appropriate firewall rules and security configurations;
  • Monitoring your services for signs of compromise or unauthorized access.

SolaDrive makes no express or implied warranties regarding the security or functionality of third-party software or scripts installed on customer servers. You are solely responsible for the security of your hosted content and applications.

6. Email Sending Requirements

Unsolicited bulk emailing, snowshoe spam operations, and email address verification or probing are strictly prohibited. SolaDrive prohibits any mailing behavior that would be considered abusive or could negatively impact IP mailing reputations.

Bulk Commercial Email Requirements

You must obtain SolaDrive’s advance approval for any bulk commercial email. Approval will not be given unless you demonstrate all of the following:

  • Consent Requirement: Your intended recipients have given their consent to receive email via some affirmative means, such as an opt-in procedure;
  • Consent Verification: Your procedures for soliciting consent include reasonable means to ensure the person giving consent is the owner of the email address;
  • Consent Records: You retain evidence of the recipient’s consent in a form that may be promptly produced on request, and you honor requests to produce consent evidence within 72 hours;
  • Revocation Process: You have procedures that allow a recipient to easily revoke their consent (such as an unsubscribe link). Revocations must be honored within 72 hours;
  • Privacy Policy: You must have a Privacy Policy posted for each domain associated with the mailing;
  • Complaint Tracking: You have the means to track anonymous complaints;
  • Transparency: You may not obscure the source of your email. Your email must include the recipient’s email address in the body or “TO” line;
  • Legal Compliance: You must comply with the CAN-SPAM Act and other applicable laws.
Notice: SolaDrive does not guarantee or warrant the mail sending reputation of any provided IP address. Customers must address any complaints received about unsolicited or spam email promptly to prevent account suspension or termination.

Unsolicited Email

You may not send any unsolicited email, either in bulk or individually, to any person who has indicated that they do not wish to receive it. You must comply with the rules of any other network you access or participate in using SolaDrive’s services.

7. Material Protected by Copyright

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:

  • You have been expressly authorized by the owner of the copyright for the work to copy the work in that manner; or
  • You are otherwise permitted by established United States copyright law to copy the work in that manner.

SolaDrive will terminate the service of repeat copyright infringers.

8. Copyright Infringement Notice (DMCA)

If you believe your copyright is being infringed by a person using the SolaDrive network, please send your written notice of copyright infringement to:

Your notice must include the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single site are covered by a single notification, a representative list of such works at that site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit SolaDrive to locate the material;
  • Information reasonably sufficient to permit SolaDrive to contact you, such as an address, telephone number, and, if available, an email address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

9. Professional Conduct

SolaDrive maintains a zero-tolerance policy regarding harassment, malice, or abuse directed at our employees, representatives, or subsidiaries. Any form of harassment, including but not limited to abusive language, cursing, threats, or expressions of hostility toward our staff or authorized agents, is strictly prohibited.

Customers are expected to uphold professionalism in all interactions with our team, whether via email, phone, live chat, support tickets, or any other communication channel.

Important: In the event a customer violates this policy, we reserve the right to take corrective action, which may include service suspension or termination. Such action may be taken with or without prior notice and without liability to the customer.

10. IP Addresses

SolaDrive assigns IP addresses to clients following ARIN guidelines (https://www.arin.net/policy/nrpm.html). All IP allocations must comply with these policies.

SolaDrive reserves the right to request verification of assigned IP addresses at any time and may revoke IP assignments at its discretion. IP addresses remain the property of SolaDrive and are assigned for use only with active SolaDrive services.

11. Abuse Tickets

SolaDrive’s standard policy is to notify customers of AUP or TOS violations; however, SolaDrive reserves the right to suspend or terminate accounts with or without notice. Customers must keep their primary contact email up to date with SolaDrive.

Violation details will be sent to the customer’s primary email with a timeframe to resolve the issue. SolaDrive retains discretion on response time and further actions if the issue is not addressed.

Examples of Violations and Actions

  • Phishing: Offending files are immediately disabled, with a 24-hour window for customers to secure the site. Failure to respond may lead to suspension of individual sites or full account suspension.
  • Spam Complaints: SolaDrive investigates and may disable spam sources, such as scripts or account access, pending customer response within 24 hours. Further actions, including system-wide SMTP filters or account suspension, may occur if unresolved.
  • Resource Abuse: SolaDrive provides a best-effort analysis, allowing time to correct resource issues. If unresolved, SolaDrive may take actions including disabling plugins, scripts, or full service suspension based on severity.
  • Malware/Compromised Sites: Infected files may be quarantined or removed immediately to protect network integrity. Customers will be notified and given time to clean and secure their sites.

These examples serve as general guidelines. SolaDrive reserves the right to determine appropriate actions for each case.

12. Disclaimer

SolaDrive is not obligated, nor does it assume any responsibility, to monitor or oversee customer activities under this AUP. SolaDrive disclaims all liability for any misuse, unauthorized access, or violations occurring on the SolaDrive network by its customers.

While SolaDrive reserves the right to investigate and respond to reported violations or abuses, the responsibility for ensuring compliance with all applicable laws, regulations, and policies remains solely with the customer. SolaDrive may, at its discretion, take appropriate action when aware of misuse, but this does not constitute a duty to monitor or control customer actions proactively.
